Terms and Conditions

1. DEFINITIONS AND PARTIES

In these Terms and Conditions:

By making a booking, the Lead Booking Name confirms that they have full authority to accept these Terms & Conditions on behalf of all accompanying guests.

2. BOOKINGS

A binding contract is formed only when:

1. The required deposit has been received by the Company, and

2. A written booking confirmation has been issued to the Client.

No verbal agreements are binding unless confirmed in writing by the Company.

3. PAYMENT AND CONFIRMATION

3.1 Deposit & Final Payment

3.2 Late Bookings

Reservations made within 12 weeks of arrival require 100% non-refundable payment at the time of booking.

3.3 Failure to Pay

If any payment is not received in full by the deadline, the Company reserves the right to cancel the booking immediately, regardless of any previous payments made.

3.4 Payment Methods & Exchange Rates

4. CANCELLATION BY CLIENT

4.1 Strict Non-Refund Policy

All payments are strictly non-refundable, including deposits and balances.

4.2 Outstanding Balances

If a cancellation is submitted, the Client remains liable for any outstanding sums due at the time of cancellation.

4.3 How to Cancel

Cancellations must be submitted in writing via email.

A cancellation is not valid until acknowledged by the Company in writing with a reference number.

4.4 Third-Party Costs

The Client is liable for all third-party cancellation charges (transfers, excursions, yacht hire, helicopter services, etc.).

All such fees must be reimbursed promptly upon request.

We strongly advise obtaining comprehensive travel insurance with cancellation protection.

5. AMENDMENTS BY CLIENT

5.1 Changes to Dates or Guest Details

Any changes requested by the Client (including dates, duration, occupancy, or guest names) are subject to Company approval at its sole discretion.

The Company is under no obligation to accept amendments.

5.2 Early Departure

If the Client leaves Gökçe Gemile early for any reason not covered under Clause 9 (Force Majeure),no refund, credit, or alternative dates will be offered.

6. CHANGES & CANCELLATION BY THE COMPANY

6.1 Company’s Right to Modify or Cancel

The Company may need to alter or cancel a booking.

Whether a change is minor or substantial is determined entirely at the Company’s discretion.

6.2 Minor Changes

Minor changes will be substituted with comparable alternatives, which the Client agrees to accept.

6.3 Substantial Changes

If a substantial change occurs, alternative arrangements may be offered. The Client may accept or decline these.

6.4 Rejection & Refunds

If no suitable alternative is offered, or if the Client rejects substantial changes:

Compensation for cancellations or changes is limited solely to the refund described above.

No additional compensation or consequential loss is payable.

6.6 Client Default

The Company accepts no liability for cancellations arising from the Client’s own default or failure to comply with payment schedules.

6.7 Misconduct - Immediate Removal

The Company reserves the right to:

The Client shall indemnify the Company against all resulting loss or damage.

7. TRANSFER OR RESALE OF BOOKINGS

Your booking may not be resold, transferred, awarded as a prize, or reassigned without prior written consent from the Company.

Such consent may include restrictions on how the booking may be promoted.

8. LIABILITY OF THE COMPANY

8.1 General Limitations

The Company is not liable for:

The maximum liability in any scenario is limited to twice the amount paid for accommodation.

8.2 Negligence

Nothing excludes liability for death or serious injury caused by the Company’s proven negligence.

8.3 Insurance Requirement

Clients must ensure adequate travel and medical insurance.

The Company is not responsible for losses not covered by insurance.

9. FORCE MAJEURE

If travel is disrupted by war, terrorism, natural disasters, severe weather or government advisories, the Company will use reasonable endeavours to reschedule the stay.

If rescheduling is not possible, refunds will be made minus reasonable expenses.

If departure is required due to severe weather, the Company will attempt to offer replacement dates equivalent to lost nights, subject to availability.

10. DATA PROTECTION

Client data is processed in accordance with Turkish data protection legislation.

Personal data is not shared with third parties unless necessary for operational purposes or required by law.

Clients may opt out of marketing communication at any time by emailing [email protected].

11. ENTIRE AGREEMENT & VALIDITY

These Terms represent the entire agreement between the Company and the Client.

The Company reserves the right to update these Terms, and the revised version will apply to any future booking.

If any clause is held invalid, the remainder shall continue in full force.

12. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the Republic of Turkey.

Disputes fall under the exclusive jurisdiction of the Courts of Fethiye, Turkey,

though the Company may pursue legal action in any jurisdiction where the Client resides or holds assets.

13. PROPERTY USE, OCCUPANCY & HOUSE RULES

13.1 Occupancy & General Behaviour

13.2 Check-in & Check-out

Early arrival or late departure is subject to availability, requires approval and may incur fees.

Failure to vacate by 12:00 may result in additional charges.

13.3 Smoking Policy (Strict Fire Prevention)

13.4 Noise & Respect

Guests must maintain a respectful environment at all times.

Excessive noise, disruptive behaviour or any disturbance may result in removal under Clause 6.7.

13.5 Prohibited Activities

Without written approval, guests may not:

Clients are liable for any damage, breakage or excessive cleaning caused by their party.

Charges may be applied before or after departure.

13.7 Safety Use of Facilities

Use of all facilities-including pools, beaches, pathways, natural areas and the funicular-is entirely at the Client’s own risk.

Guests must follow all safety instructions provided by staff.
