Gökçe Gemile Private Bay
Effective Date: 19 August 2026
These Terms & Conditions govern bookings and stays at Gökçe Gemile Private Bay.
They are intended to establish clear booking terms while protecting the safety and privacy of our guests, the integrity of the estate and the exceptional Mediterranean landscape in which Gökçe Gemile Private Bay is located.
Please read these Terms carefully before confirming a reservation.
1. DEFINITIONS AND PARTIES
1.1 The Company
“The Company”, “We”, “Us” and “Our” refer to Falcon Tourism Co. Ltd, incorporated under the laws of the Republic of Türkiye and operating Gökçe Gemile Private Bay.

1.2 The Client
“The Client” and “You” refer to the individual or legal entity making the booking or identified in the written booking confirmation as the contracting party.
1.3 Lead Guest
The “Lead Guest” means the individual identified as the principal guest responsible for the booking party.
The Lead Guest must be at least 18 years old and legally capable of entering into a contract.
1.4 Guests
“Guests” means all persons staying at, visiting or entering Gökçe Gemile Private Bay in connection with the booking.
1.5 The Property
“The Property” means Gökçe Gemile Private Bay and, as applicable to the particular booking, the reserved villa or villas and the associated estate areas, gardens, pools, waterfront areas, paths, natural areas and facilities made available to Guests.
1.6 Responsibility of the Lead Guest
By confirming a booking, the Lead Guest confirms that they are authorised to make the reservation and accepts responsibility for communicating these Terms & Conditions to all members of their party.
Entry to and continued use of the Property by every Guest is conditional upon compliance with the applicable provisions of these Terms, including the House Rules and The Gökçe Gemile Private Bay Pledge.
The Lead Guest is responsible for taking reasonable steps to ensure that all members of the party comply with them.
2. BOOKINGS AND ACCEPTANCE OF TERMS
2.1 Formation of the Booking Contract
A binding booking contract is formed only when:
An enquiry, quotation, availability indication, provisional reservation or verbal discussion does not by itself constitute a confirmed booking.
2.2 Written Arrangements
Only arrangements confirmed in writing by the Company form part of the booking.
No verbal representation, amendment, special request or agreement is binding unless confirmed in writing by the Company.
2.3 Acceptance of These Terms
By proceeding with the required booking payment after being provided with or given access to these Terms & Conditions, the Client acknowledges and accepts them as part of the booking contract.
These Terms expressly include:
2.4 Distance and Online Bookings
Where a booking is made through the website, email, telephone, messaging service or another form of distance communication, the Company will provide the information required by applicable law before the Client becomes bound by the booking.
Accommodation provided for a specified date or period may be excluded from any statutory cooling-off or withdrawal right where applicable law so provides.
Nothing in these Terms excludes any mandatory consumer right which cannot lawfully be excluded.
2.5 Travel Agents, Platforms and Intermediaries
Where a reservation is made through a travel agent, tour operator, booking platform or other intermediary, separate terms relating to payment, cancellation or the intermediary's own service may also apply.
If the booking channel expressly provides payment or cancellation conditions different from these Terms, the conditions applicable to that particular booking will be those confirmed through the relevant booking channel.
Regardless of booking channel, the safety, occupancy, privacy, fire-prevention, environmental and Property-use rules contained in these Terms apply to all Guests to the extent they have been incorporated into or communicated in connection with the stay.
3. PRICES, PAYMENT AND CONFIRMATION
3.1 Deposit
A 25% non-refundable accommodation deposit is required to secure a direct reservation unless different payment terms are expressly stated in the written booking confirmation.
The Property is not secured until the required payment has been received or successfully authorised and the Company has issued written confirmation.
3.2 Final Balance
The remaining 75% accommodation balance is due no later than 12 weeks before the scheduled arrival date.
Once due and paid, the balance is non-refundable in accordance with Clause 4, subject to mandatory applicable law.
3.3 Bookings Within 12 Weeks of Arrival
Reservations confirmed within 12 weeks of arrival require 100% payment at the time of booking.
Such payment is non-refundable in accordance with Clause 4, subject to mandatory applicable law.
3.4 Failure to Pay
If any payment is not received in full by the required deadline, the Company may treat the reservation as cancelled by the Client and release the reserved dates without further obligation to continue holding the Property.
Any sums already paid will be dealt with in accordance with the cancellation provisions applicable to the booking.
3.5 Principal Currency
Because Gökçe Gemile Private Bay welcomes guests from many different countries, Euro (EUR) is used as the principal international reference currency for accommodation pricing, unless otherwise expressly stated in the quotation or booking confirmation.
Where permitted by applicable law, accommodation prices and payment obligations may be quoted, agreed and paid in Euro.
3.6 Payment in Other Currencies
At the Client’s request and subject to applicable law and the Company's approval, payment may also be accepted in another currency, including Turkish Lira (TRY) or United States Dollars (USD).
Where an amount priced in Euro is converted into another currency:
Where applicable law requires a consumer-facing price or payment amount to be displayed or communicated in Turkish Lira, the Company will provide the required Turkish Lira amount accordingly.
3.7 Additional Guests and Services
The confirmed accommodation price is based on the occupancy stated in the booking confirmation.
Additional approved Guests may result in an additional accommodation charge.
Optional services, including but not limited to:
may be charged separately.
Any additional charge will be communicated before the relevant additional service or occupancy change is confirmed.
3.8 Payment Charges
Any mandatory payment or processing fee charged directly by the Company will be disclosed before payment.
The Company is not responsible for fees independently charged by banks, card issuers, payment providers or correspondent institutions.
4. CANCELLATION BY THE CLIENT
4.1 Non-Refundable Accommodation Policy
Unless expressly stated otherwise in the written booking confirmation, accommodation payments made to secure specified dates are non-refundable.
This includes:
The non-refundable nature of the reservation reflects the fact that accommodation is reserved exclusively for the Client for specified dates and those dates are removed from availability.
This policy applies subject to any mandatory legal right which cannot lawfully be excluded.
4.2 Amounts Already Due
Cancellation does not extinguish a payment obligation which had already become due before the Company's receipt of the cancellation.
4.3 Cancellation Procedure
Cancellation must be submitted to the Company in writing, preferably by email.
A cancellation will be treated as received when acknowledged in writing by the Company.
4.4 Third-Party Services
Transfers, yacht charters, excursions, activities, entertainment, external suppliers, event services and other third-party arrangements may be subject to separate cancellation conditions.
The Client is responsible for any third-party cancellation costs which were disclosed or agreed before the relevant service was confirmed.
4.5 Travel Insurance
Guests are strongly advised to obtain comprehensive travel insurance appropriate to their circumstances, including cover for:
5. AMENDMENTS REQUESTED BY THE CLIENT
5.1 Changes to the Booking
Any request to change:
is subject to availability and written approval by the Company.
The Company is not obliged to accept a requested amendment.
5.2 Revised Pricing
An approved amendment may result in a revised price where seasonal rates, occupancy, duration or other relevant booking circumstances differ from the original reservation.
Any revised price will be communicated before the amendment becomes binding.
5.3 Early Departure
If the Client or any Guest voluntarily leaves the Property before the confirmed departure date, no refund, credit or replacement stay will normally be provided for unused accommodation.
This does not affect any mandatory legal right that cannot lawfully be excluded.
6. CHANGES OR CANCELLATION BY THE COMPANY
6.1 Minor Changes
Occasionally, operational, maintenance or safety requirements may make minor changes necessary.
Where reasonably possible, the Company will provide a comparable arrangement without materially reducing the accommodation contracted for.
6.2 Substantial Changes
If the Company is unable, for reasons within its reasonable control, to provide a material part of the confirmed accommodation, it will where reasonably possible:

If the Company cancels confirmed accommodation for reasons within its control and no suitable alternative is accepted, payments received for the accommodation which cannot be provided will be refunded.

7. GUEST MISCONDUCT AND TERMINATION OF STAY
7.1 Protection of Guests, Staff, Property and Environment
The Company may take reasonable and proportionate action where the behaviour of a Client or Guest creates a serious risk to:

Where reasonably necessary because of a serious or material breach, the Company may:
Where a stay is lawfully terminated because of a serious breach attributable to the Client or their party, no refund will be due for unused accommodation to the extent permitted by applicable law.
7.4 Liability for Resulting Loss
The Client is responsible for reasonable and legally recoverable loss or damage directly caused by the acts or omissions of the Client or members of their party.
8. TRANSFER, RESALE AND COMMERCIAL DISPOSAL OF BOOKINGS
A booking is personal to the Client and may not be:

Any approved transfer may be subject to reasonable conditions imposed by the Company.
9. THIRD-PARTY SERVICES
Certain optional services may be supplied by independent third-party providers.
These may include:
Where the Company clearly acts only as an intermediary in arranging a separately provided third-party service, the independent provider remains responsible for performing its own service and may apply its own terms.
Nothing in this clause excludes any responsibility which applicable law requires the Company itself to bear.
10. LIABILITY AND INSURANCE
10.1 Reasonable Care
The Company will exercise reasonable care in providing accommodation and services for which it is directly responsible.
10.2 Matters Outside the Company's Responsibility
Subject to applicable law, the Company is not responsible for loss arising solely from:
10.3 Indirect Loss
To the extent permitted by law, the Company is not responsible for indirect, special or consequential loss which was not reasonably foreseeable when the booking contract was formed.
10.4 Liability Cap
To the maximum extent permitted by applicable law, and excluding liabilities which cannot lawfully be limited, the Company's aggregate contractual liability for direct financial loss relating to a booking shall not exceed twice the total accommodation amount paid to the Company for that booking.
10.5 Liability Which Is Not Excluded
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, including liability arising from fraud, wilful misconduct, gross fault or death or personal injury where such liability cannot lawfully be excluded.
10.6 Insurance
The Client is responsible for arranging appropriate travel, health and personal insurance for their party.
11. FORCE MAJEURE
11.1 Definition
“Force Majeure” means an extraordinary event or circumstance outside the reasonable control of the affected party which prevents, materially restricts or makes unsafe the performance of the booking.
Depending on the circumstances, this may include:
11.2 Where the Property Remains Available
Where the Property remains lawfully open, safe and available but the Client is unable or chooses not to travel because of circumstances affecting the Client, their transport arrangements or their personal situation, the normal cancellation conditions will continue to apply.
The Company may, at its discretion and subject to availability, offer alternative dates, but is not obliged to do so unless required by applicable law.
11.3 Where Accommodation Cannot Be Provided
Where Force Majeure makes it impossible, unlawful or unsafe for the Company to provide the confirmed accommodation, the Company will seek a reasonable solution where circumstances permit.
This may include:
Where applicable law requires a refund because the contracted accommodation cannot be provided, the Company will make the legally required refund.
11.4 Emergency Evacuation During a Stay
Where Guests must leave the Property because of wildfire, mandatory evacuation, severe weather or another serious emergency, the safety of Guests and staff will take priority over continued occupancy.
The Company will use reasonable efforts to assist Guests and will deal with any unused accommodation in accordance with applicable law and the circumstances of the event.
12. DATA PROTECTION AND PRIVACY
The Company processes personal data in accordance with applicable Turkish data-protection legislation, including Law No. 6698 on the Protection of Personal Data (KVKK).

Acceptance of these Terms & Conditions does not constitute separate consent to marketing or to any processing activity for which explicit consent is legally required.
Where explicit consent is required, it will be requested separately.
Guests may opt out of optional marketing communications at any time.
13. GOVERNING LAW, PLACE OF PERFORMANCE AND JURISDICTION
13.1 Governing Law
These Terms & Conditions, the booking contract and all matters arising out of or in connection with the accommodation shall be governed by the laws of the Republic of Türkiye.
Nothing in this clause removes a mandatory legal protection which applicable law does not permit the parties to waive.
13.2 Contractual Place of Performance
The Parties expressly acknowledge that the principal accommodation and estate services contracted for are physically performed at:

Accordingly, Fethiye, Muğla is expressly agreed and acknowledged as the principal contractual place of performance of the accommodation and estate services provided by the Company.
13.3 Fethiye Courts and Enforcement Offices
To the fullest extent permitted by applicable law, the Courts and Enforcement Offices of Fethiye, Muğla, Türkiye shall have exclusive jurisdiction in respect of disputes, claims or proceedings arising out of or connected with:
13.4 Commercial, Corporate and Agency Bookings
Where the Client is:
the parties expressly agree, to the fullest extent legally permitted, that the Courts and Enforcement Offices of Fethiye, Muğla shall have exclusive jurisdiction.
This provision is intended to constitute an express jurisdiction agreement between commercial parties wherever such agreement is valid under applicable law.
13.5 Consumer Bookings
Where the Client qualifies as a consumer under mandatory applicable law, the parties nevertheless expressly agree that:
Nothing in this clause is intended to remove a specific Consumer Arbitration Committee, Consumer Court, court of residence or other mandatory forum or remedy which applicable law expressly grants to a consumer and does not permit the consumer to waive in advance.
Any such mandatory exception shall be interpreted narrowly and shall not otherwise affect the parties' agreement concerning Turkish law, the Fethiye place of performance and Fethiye jurisdiction.
13.6 Enforcement and Protective Measures
Nothing in this Clause prevents the Company from:
13.7 Preliminary Dispute Resolution
Before commencing substantive court proceedings, the parties should, where reasonably possible and without prejudicing mandatory rights or limitation periods, first attempt in good faith to resolve the matter through written communication.
Where mediation or another preliminary dispute-resolution procedure is mandatory under Turkish law, the parties shall comply with that requirement.
14. OCCUPANCY, GUESTS AND VISITORS
14.1 Maximum Occupancy
The maximum overnight occupancy of the reserved villa or villas must not exceed the number confirmed in the booking unless prior written approval is obtained from the Company.
Additional approved Guests may be subject to additional accommodation charges.
14.2 Guest Identification
Guests must provide identification or other information reasonably required for check-in, security or compliance with applicable legal obligations.
Where the Company is legally required to obtain particular Guest information, failure to provide it may prevent check-in or continued accommodation.
14.3 Outside Visitors
Only registered or approved Guests may stay overnight.
Outside visitors may not enter or remain at the Property without prior approval from the Company.
Approved visitors may be subject to:
14.4 Responsibility for Visitors
The Client remains responsible for ensuring that any approved visitor connected with their booking complies with the applicable House Rules while at the Property.
14.5 Children
Children are welcome.
Parents, guardians and responsible adults must supervise children appropriately at all times, particularly around:

Pets are not permitted unless expressly approved in writing by the Company.
15. CHECK-IN, CHECK-OUT AND STAFF ACCESS
15.1 Check-in and Check-out
Early check-in or late check-out is subject to availability and prior approval and may incur an additional charge.
Guests must vacate the Property by the agreed departure time.
15.2 Staff Access
Gökçe Gemile Private Bay places great importance on Guest privacy.
However, authorised staff may enter accommodation or estate areas where reasonably necessary for:
Where circumstances reasonably permit, appropriate notice will be given before access.
16. STRICT FIRE PREVENTION AND SMOKING POLICY
16.1 Exceptional Fire Risk
Gökçe Gemile Private Bay is surrounded by Mediterranean forest and natural vegetation.
During dry periods, a single flame, ember or improperly extinguished cigarette can create an extremely serious wildfire risk.
Fire prevention is therefore a fundamental condition of every stay.
16.2 Smoking
Smoking is strictly prohibited:
Smoking outdoors is permitted only in safe locations designated or approved for smoking and where an appropriate ashtray is provided.
All cigarettes and cigars must be completely extinguished.
No cigarette end, cigar end, match or smoking-related waste may ever be thrown:
16.3 Open Flames and Fire-Producing Items
Unless expressly organised, authorised and where appropriate supervised by the Company, Guests must not use:
16.4 Fire-Safety Instructions
Guests must comply immediately with reasonable instructions issued by the Company or its staff concerning wildfire risk, smoking restrictions, fire prevention, evacuation or emergency procedures.
Restrictions may be increased temporarily where weather, official warnings or local conditions create an elevated fire risk.
16.5 Serious Fire-Safety Breach
A deliberate, reckless or repeated breach which creates a significant fire risk constitutes a serious breach of these Terms.
Where reasonably necessary, such breach may result in immediate removal from the Property and termination of the stay without refund, to the extent permitted by applicable law.
Any person responsible for causing a fire may also be liable for resulting damage, emergency costs and other legally recoverable losses.
17. SAFETY, SEA, FUNICULAR AND EQUIPMENT
17.1 Natural Environment
Gökçe Gemile Private Bay is located within a natural Mediterranean coastal landscape.
Guests should expect natural terrain, vegetation, wildlife, rocks, pathways, changes in level and changing sea and weather conditions.
Guests must exercise reasonable care appropriate to the environment.
17.2 Pools and Sea
Guests using swimming pools, the sea and waterfront areas must take reasonable precautions and assess their own swimming ability and physical capability.
Children and persons requiring supervision must be appropriately supervised.
17.3 Funicular
Guests must follow all instructions relating to operation and use of the funicular.
Guests must not interfere with:
Children must be appropriately supervised.
17.4 Boats, Vehicles, Sea Scooters and Equipment
Guests may not operate, move, borrow or use any:
belonging to the Company or another person unless express authorisation has first been given.
Where a licence, supervision, training or safety equipment is required by law or by the Company, the relevant equipment may not be used until those requirements have been satisfied.
17.5 Safety Instructions
Guests must comply promptly with reasonable safety instructions relating to:
18. SILENCE, PRIVACY AND RESPECT
18.1 Quiet Character of the Estate
Silence and privacy are fundamental characteristics of Gökçe Gemile Private Bay.
Guests must avoid excessive, persistent or unreasonable noise and act with consideration for other Guests, staff and the surrounding natural environment.
18.2 Privacy
Guests must respect the privacy of:
Guests must not intentionally photograph, film, record, track or surveil another person in circumstances where that person may reasonably expect privacy.
18.3 Serious Disturbance
Serious or repeated disturbance which materially interferes with the privacy, safety or peaceful enjoyment of others may constitute a material breach under Clause 7.
19. PHOTOGRAPHY, FILMING, DRONES AND COMMERCIAL USE
Ordinary personal photography and filming are permitted provided they do not interfere with the privacy, safety or enjoyment of others.
Without prior written approval from the Company, Guests may not:
Approved commercial production may be subject to separate agreements, operational requirements and fees.
20. EVENTS, WEDDINGS, CELEBRATIONS AND GATHERINGS
20.1 Prior Approval
No wedding, celebration, reception, party, organised gathering, commercial event or similar occasion may take place at Gökçe Gemile Private Bay without prior written approval from the Company.
20.2 Maximum Attendance
Unless a lower capacity is specified for a particular approved event, the maximum attendance for any private wedding or celebration at Gökçe Gemile Private Bay is 30 persons in total, including resident Guests and approved non-resident attendees.
20.3 Event Approval Is Date-Specific
Approval of an event applies only to:
Approval and payment for one celebration day does not constitute approval or payment for additional event days.
20.4 Additional Celebration Days
Any additional:
taking place on a different day must be approved separately.
Additional event days may result in additional venue, staffing, security, service, cleaning or operational charges.
20.5 External Suppliers
Wedding planners, event organisers, performers, musicians, photographers, videographers, decorators, caterers, technical teams and other external suppliers may enter the Property only with prior approval from the Company.
The Company may impose reasonable requirements concerning:
21. DAMAGE, LOSS AND EXCESSIVE CLEANING
The Client and Guests must take reasonable care of the Property, furnishings, equipment and natural surroundings.
The Client is responsible, to the extent permitted by law, for reasonable costs arising from damage or loss caused by the Client, Guests or approved visitors beyond ordinary wear and tear.
The Company may invoice the Client for reasonable and documented costs relating to:

22. ENVIRONMENTAL PROTECTION, WASTE AND NATURAL LIFE
22.1 Leave No Trace
No rubbish or waste may be left:
Waste must be placed in the appropriate facilities provided.
22.2 Plastics
Gökçe Gemile Private Bay seeks to minimise unnecessary single-use plastics.
Guests are asked to avoid unnecessary disposable plastic products wherever reasonably possible and must ensure that no plastic waste enters the natural environment or sea.
22.3 Sea and Wildlife
Guests must not deliberately:
wild animals or marine life in a manner likely to alter their natural behaviour or place them at risk.
22.4 Plants and Natural Formations
Guests must not deliberately:

Fresh water and energy should be used comfortably but responsibly.
Guests are asked to avoid unnecessary waste and to respect the particular environmental conditions of a secluded coastal estate.
23. THE GÖKÇE GEMİLE PRIVATE BAY PLEDGE
A Promise to the Peninsula
Gökçe Gemile Private Bay exists within a rare Mediterranean landscape of forest, secluded coves, clear water and natural life.
The privacy and freedom experienced here are possible because this landscape has remained quiet, uncrowded and carefully protected.
Every person who spends time here is therefore asked to recognise a simple principle:

By booking and staying at Gökçe Gemile Private Bay, Guests share the following commitment.
23.1 We Protect the Peninsula from Fire
We understand that the surrounding forest is exceptionally vulnerable to fire.
We will treat every flame, ember and cigarette with the seriousness this landscape requires.
We will never knowingly or recklessly create an unnecessary fire risk.
23.2 We Smoke Responsibly
We will smoke only in safe, approved areas where an ashtray is provided.
We will never smoke while walking through the forest or close to dry vegetation.
Every cigarette will be completely extinguished.
No cigarette end will ever be left in nature.
23.3 We Leave No Trace
Nothing we bring into this landscape should remain behind.
We will minimise unnecessary single-use plastics wherever reasonably possible and will never leave plastic, glass, packaging, cigarette ends or other waste in the forest, on the coastline or in the sea.
What belongs to nature remains in nature.
What belongs to us leaves with us.
23.4 We Respect the Sea and Its Life
The waters surrounding Gökçe Gemile form part of a living Mediterranean ecosystem.
We will not deliberately harm, chase, capture or unnecessarily disturb wildlife.
We will experience the sea as guests of the landscape.
23.5 We Protect the Forest and Natural Landscape
We will not damage trees, plants or natural formations or unnecessarily remove elements of the natural landscape.
We want the peninsula to remain as beautiful for those who come after us - and for the wildlife that lives here - as it was when we arrived.
23.6 We Preserve the Silence
Silence is one of the rarest luxuries of Gökçe Gemile Private Bay.
We will respect the natural rhythm of the peninsula and avoid unnecessary disturbance, particularly in the forest, along the coastline and during the evening and night.
23.7 We Respect Privacy
Privacy is fundamental to life at Gökçe Gemile Private Bay.
We will respect the private space of others and use photography, filming and technology in a way that does not intrude upon another person's privacy.
23.8 We Use Natural Resources Thoughtfully
Fresh water, energy and natural resources are precious within this secluded coastal environment.
We will enjoy them comfortably, but without unnecessary waste.

The Gökçe Gemile Private Bay Pledge forms an integral part of these Terms & Conditions.
Where a provision of the Pledge concerns a specific fire, safety, privacy, environmental or Property-use obligation addressed elsewhere in these Terms, the corresponding specific provision of these Terms shall apply and shall be enforceable as part of the booking contract.
24. ENTIRE AGREEMENT, SEVERABILITY, UPDATES AND WAIVER
24.1 Entire Agreement
The written booking confirmation, confirmed booking details, these Terms & Conditions and any other document expressly incorporated into the booking together constitute the agreement between the Company and the Client.
24.2 Severability
If any provision of these Terms is held to be unlawful, invalid or unenforceable, it shall, where legally possible, be interpreted or limited only to the minimum extent necessary to make it enforceable.
If this is not possible, the affected provision shall be severed without affecting the validity of the remaining provisions.
24.3 No Waiver
A failure or delay by the Company in enforcing any provision on one occasion does not constitute a permanent waiver of that provision or prevent its enforcement on another occasion.
24.4 Updates to Terms
The Company may update these Terms from time to time.
Unless required by law or agreed with the Client, a later version will not retrospectively change the material contractual terms of an already confirmed booking.
The version applicable to a booking will normally be the version presented to and accepted by the Client when the booking was confirmed.
24.5 Updated Safety Instructions
Nothing in Clause 24.4 prevents the Company from introducing or modifying reasonable operational, fire-prevention, security or emergency instructions during a stay where necessary to respond to changing conditions or protect Guests, staff, the Property or the natural environment.
BOOKING ACKNOWLEDGEMENT
By confirming a reservation and making the required payment after being provided with or given access to these Terms & Conditions, the Client acknowledges and accepts these Terms, including the Property Use & House Rules and The Gökçe Gemile Private Bay Pledge.
The Lead Guest further accepts responsibility for ensuring that the members of their party are informed of and comply with the applicable rules throughout their stay.
